End User License Agreement

This End User License Agreement ("EULA" or "Agreement") is a legal agreement between you ("User," "you," or "your") and RKNova Technologies, LLC ("RKNova," "we," "us," or "our") governing your use of the RKNova website, customer portal, and any software tools or applications we make available to you in connection with our technology services. By accessing or using our website or any associated software, you acknowledge that you have read, understood, and agree to be bound by this EULA. If you do not agree to these terms, do not use our website or software.

1. Grant of License

Subject to your compliance with this EULA, RKNova grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to:

• Access and use our website and customer portal for the sole purpose of booking, managing, and reviewing RKNova technology services.
• Download and use any diagnostic tools or remote-support software explicitly provided by RKNova technicians during a service session, strictly for the duration of that session.
• Access any written guides, documentation, or instructional content provided by RKNova solely for your personal, non-commercial reference.

This license does not transfer any ownership interest in the software or content to you.

2. Restrictions

You agree that you will not, and will not allow any third party to:

• Copy, modify, adapt, translate, reverse engineer, decompile, disassemble, or attempt to extract source code from any part of our website or software.
• Distribute, sell, sublicense, rent, lease, or otherwise transfer your rights under this license to any third party.
• Remove, alter, or obscure any proprietary notices, labels, trademarks, or copyright notices on the website or software.
• Use automated scripts, bots, crawlers, or data-scraping tools to access, query, or harvest content from our website without prior written consent.
• Use the website or software to transmit malware, spam, or harmful code, or to conduct phishing, denial-of-service attacks, or any other unlawful activity.
• Attempt to gain unauthorized access to any part of our systems, networks, databases, or servers.
• Use the website or software for any commercial purpose other than booking and managing RKNova services for your own use.

3. Intellectual Property Ownership

RKNova and its licensors retain all right, title, and interest — including all intellectual property rights — in and to the website, customer portal, software, and all content, graphics, logos, trademarks, service marks, trade dress, and compilations therein. This EULA does not grant you any ownership rights. All rights not expressly granted herein are reserved by RKNova.

4. Remote Support Software

When you request remote technical assistance, our technicians may ask you to install or run a remote-access tool (e.g., a screen-sharing or remote control application) to diagnose or fix an issue on your device. By consenting to a remote support session you agree that:

• The technician will access your device solely to perform the agreed service and will terminate the session upon completion.
• You will not share the session link or code with any third party.
• You are responsible for removing any remote-access software once the session concludes. See our Uninstall Instructions for guidance.
• RKNova will not retain persistent remote access to your device after the session ends.

5. User Accounts

To access certain features of our customer portal, you may be required to create an account. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify RKNova immediately at support@rknova.in of any unauthorized use of your account or any other breach of security.

6. Updates and Modifications

RKNova may update, modify, or discontinue the website, customer portal, or any software at any time, with or without prior notice. Updates may be required for continued use. RKNova is not obligated to maintain backward compatibility or provide specific features in any update. Continued use of the website or software after an update constitutes acceptance of the updated version.

7. Privacy

Your use of our website and software is also governed by our Privacy Policy, which is incorporated into this EULA by reference. By using our website or software you consent to the data practices described in the Privacy Policy.

8. Disclaimer of Warranties

THE WEBSITE AND ANY SOFTWARE ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RKNOVA EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. RKNOVA DOES NOT WARRANT THAT THE WEBSITE OR SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RKNOVA'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING UNDER OR RELATED TO THIS EULA OR YOUR USE OF THE WEBSITE OR SOFTWARE SHALL NOT EXCEED THE AMOUNT YOU PAID TO RKNOVA IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER. IN NO EVENT SHALL RKNOVA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

10. Termination

This EULA is effective from the date you first use our website or software and continues until terminated. RKNova may terminate your license immediately, without notice, if you breach any provision of this EULA. Upon termination, you must cease all use of the website and software and destroy any copies in your possession. Sections 3, 8, 9, and 11 survive termination.

11. Governing Law

This EULA is governed by the laws of the State of Texas, USA, without regard to conflict of law principles. Any dispute arising from this EULA shall be resolved in accordance with the dispute resolution provisions of our Terms of Service.
